Kentucky Lemon Law

What is the Kentucky Lemon Law?

The Kentucky Lemon Law protects consumers who purchase or lease a brand new car or truck and experience defects or nonconformities with those vehicles. Specifically, the Lemon Law statute in Kentucky applies to any new motor vehicle (as described above) that falls under the following parameters:

  • It is intended primarily to be driven on public highways; and
  • It has experienced at least one defect that substantially impaired its use, value or safety.
How Do I Know if My Vehicle is a Lemon?

Motor vehicle manufacturers are required to repair a vehicle’s defects within a reasonable number of repair attempts. Under the Lemon Law in Kentucky, a “reasonable number of attempts” means one of the following:

  • The vehicle was taken to an authorized dealership for repairs at least four times for the same defect, within the first 12 months after the vehicle was purchased or before it was driven 12,000 miles, and that defect still exists; OR
  • The vehicle was out of service due to its repairs for at least thirty calendar days within the first 12 months after the vehicle was purchased or before it was driven 12,000 miles.

Our attorneys have represented buyers of defective cars and trucks in Kentucky for years. If you think your vehicle might be a lemon, our Kentucky Lemon Law attorneys can assist you and answer any questions that you have.

What Will the Manufacturer Do for Me if My Vehicle is a Lemon Vehicle?

If your motor vehicle is considered a lemon in the state of Kentucky, you are entitled to have the manufacturer repurchase it from you or replace it with a brand new vehicle. On the other hand, you might be able to receive a “cash-and-keep” settlement, where the manufacturer pays you money based on the diminished value of your vehicle as a result of its defects and repairs.

Brian and Taylor are car buyers who sought our firm’s assistance in regard to defects they were experiencing with their new Jeep Wrangler. Brian and Taylor took their Jeep to an authorized Chrysler dealer on multiple occasions due to defects with its engine electrical system, and it was out of service for almost 60 days as a result of the repairs. They were in need of a Kentucky consumer attorney that handled Lemon Law cases, and ultimately agreed to have our firm represent them. Throughout the course of their case, our attorneys engaged in settlement negotiations with Chrysler’s attorneys, and after just a few months, we were able to procure a reasonable and acceptable cash-and-keep settlement for Brian and Taylor. We were even able to resolve the case without having to file a lawsuit against Chrysler.

Even if your vehicle does not technically fall under the specific requirements of the Lemon Law, you may still be entitled to receive cash compensation under the Magnuson-Moss Warranty Act, the federal lemon law that applies to any defective product that comes with a manufacturer’s warranty. That law also requires the manufacturer to pay the consumer’s attorneys’ fees, so we don’t have to charge our clients for our services.
